CartStar Terms of Service
These terms govern your use of CartStar (the "App"), operated by Appify Market ("we", "us"), United States of America. By installing or using the App you ("Merchant", "you") agree to them. If you do not agree, uninstall the App.
1. The service
CartStar is a Shopify app that provides a cart drawer with product recommendations, progress-based reward tiers including free shipping, free gifts and percentage discounts, and reporting on how those features perform on your store.
2. Installation and account
You must have an active Shopify store and the authority to install apps on it. You are responsible for the accuracy of what you configure, and for the settings you make live on your storefront.
3. Fees
Any fees are those shown to you at the point of installation or upgrade, and are billed through Shopify's billing system under Shopify's terms. Changes to fees will be presented to you for approval through Shopify before they take effect. Fees are non-refundable except where required by law.
4. Your responsibilities
- Complying with the laws that apply to your store, including consumer protection, advertising, tax and privacy law.
- Publishing your own privacy policy and obtaining any consent your jurisdiction requires from your customers.
- The commercial terms of any discount, free gift or shipping offer you configure, and honouring them.
- Maintaining your Shopify account and theme.
5. Acceptable use
You may not resell or sublicense the App, reverse engineer it, use it to send unsolicited messages, use it to display unlawful content, or attempt to access data belonging to another merchant or to circumvent its access controls.
6. Data processing
This section is our data processing agreement with you and applies where we process personal data on your behalf.
6.1 Roles
For personal data relating to your customers, you are the controller and we are the processor. You instruct us to process that data solely to provide the App to you.
6.2 What we process
Order line items (order id, line item id, product id, variant id, quantity, price, order date), the Shopify customer id, your product catalogue, your app settings, and anonymous records of recommendation impressions, clicks and add-to-cart actions. We do not process customer names, email addresses, phone numbers, or shipping or billing addresses. Details are in our Privacy Policy.
6.3 Our commitments
- We process personal data only on your documented instructions, which these terms constitute, unless required otherwise by law.
- We keep it confidential and limit access to those who need it to run the service.
- We maintain appropriate technical and organisational measures, including encryption in transit and at rest, signature verification on inbound webhooks, and per-store scoping of every query.
- We do not sell personal data, use it for advertising, or combine it across merchants.
- We assist you in responding to data subject requests, including through Shopify's data request and redaction flows.
- We notify you without undue delay on becoming aware of a personal data breach affecting your data.
- We make available the information reasonably necessary to demonstrate compliance with this section.
6.4 Sub-processors
You authorise us to engage the sub-processors listed in our Privacy Policy — currently Shopify, Vercel and Neon. We remain responsible for their performance. We will update that list before engaging a new sub-processor.
6.5 Deletion
On uninstall we delete your store's data as described in the Privacy Policy. Shopify's shop redaction request, sent 48 hours after uninstall, triggers deletion of the store record and all data belonging to it.
7. Intellectual property
We retain all rights in the App. You retain all rights in your store, your products and your content. You are granted a non-exclusive, non-transferable right to use the App while these terms are in force.
8. Availability
We aim to keep the App available but do not guarantee uninterrupted service. The App depends on Shopify's platform and on third-party infrastructure, and may be affected by their outages, changes or maintenance.
9. Disclaimers
The App is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will increase your sales.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total aggregate liability arising out of or relating to these terms is limited to the greater of the fees you paid us in the three months before the event giving rise to the claim, or fifty United States dollars.
11. Indemnity
You will indemnify and hold us harmless from claims arising out of your use of the App in breach of these terms, your store's content or products, or your breach of law.
12. Term and termination
These terms apply while the App is installed. You may terminate at any time by uninstalling. We may suspend or terminate access if you breach these terms, if required by Shopify, or if we discontinue the App. Sections 6.5, 7, 9, 10, 11 and 14 survive termination.
13. Changes
We may update these terms. Material changes will be communicated to merchants, and continued use after they take effect constitutes acceptance.
14. Governing law
These terms are governed by the laws of the State of Florida, United States of America, without regard to its conflict of law rules. The state and federal courts located in Florida have exclusive jurisdiction, and both parties consent to venue there.
